Senate Republicans are saving Justices Alito And Thomas
The corruption within the conservative Supreme Court majority may seem like an unsolvable problem.
Republicans control the majority in the House, and they will never lift a finger to investigate Alito and Thomas. Chief Justice John Roberts refuses to talk to Senate Democratic committee chairs about whether the self-imposed SCOTUS ethics code is being enforced.
One of the most common refrains that we hear when we write about this topic is why don’t Democrats do something? There has been a lot of ire directed toward Senate Judiciary Committee Chair Dick Durbin (D-IL) for not doing more to investigate Alito and Thomas.
On MSNBC’s The Weekend, the question of why Senate Democrats don’t do more to investigate the Supreme Court was posed to House Oversight Committee ranking member and constitutional expert Rep. Jamie Raskin (D-MD), and he answered:
In fairness to our friends over in the Senate, we've got to recognize that the committee could issue a subpoena. But what matters is whether you can enforce a subpoena. And in the Senate, you can't enforce it without 60 votes.
In other words, you need the same number you would need in order to, you know, do anything to invoke cloture or stop a filibuster. So I think that they've been proceedthey'veh us to try to get whatever information we can, and we need to take this out to the American people.
I mean, that's why AOC and I got legislation that says that the $50 gift ban that applies to all members of Congress, should apply to Supreme Court justices. Why is the Supreme Court justice collecting hundreds of thousands of dollars or millions of dollars as a frequent flyer for a frequent funder like Harlan Crowe? That doesn't make any sense. They make $300,000 a year. Pay for your own vacation. Pay for your own lunch.

Our old friend, the Senate 60-vote rule, makes another appearance again.
The 60-vote rule isn’t in the Constitution. It is just a rule made up by the Senate, and the Senate could change it at any time. The two biggest Democratic obstacles to changing the rule, Manchin and Sinema, are leaving the Senate, which could be very bad news for Alito and Thomas in January 2025, as we will discuss below.
