A new filing by Comey to dismiss the Trumped-up charges against him by the president for the May 2025 Instagram post in which he referenced a popular restaurant term by writing with seashells, “86 47” reveals pathetic details about the “vindictive and selective prosecution”, alleging federal officials misled judges, submitted false statements and withheld key facts.
In their motion to dismiss, Comey’s legal team included details about the investigation to build Trump’s ginned up “case”, including troubling accusations of “unlawful surveillance” of Comey by the Secret Service.
The document alleges a senior DOJ official requested the warrant-free location tracking of Comey shortly after his post went up, tracking Comey as he drove from North Carolina to Virginia, “including as they stopped to visit the grave of their deceased son.”
The Trump government spied on a Trump enemy as he visited the grave of his deceased son.
LEGALLY A BAD IDEA
The Trump government used a process that is supposed to be for “imminent threat to life or limb” emergencies, according to a Secret Service official quoted in Comey’s filings, who noted he told them it was “legally a bad idea” since they did not believe anyone’s life was in immediate danger.
The filings allege that the Secret Service was closely coordinating with the Justice Department and with Trump, who received frequent updates on Air Force One.
The Department of Justice is supposed to be entirely independent from the President, but under this President it has placed on the building a nearly $1 million Trump branding effort including a banner of Donald Trump. They are not making a secret of the fact that this DOJ is not independent.
RELYING ON A RUDY GIULIANI PODCAST
The Trump government is trying to argue that “86 47” was a call to violence, but they were unable to substantiate this argument in their investigation. They went so far as to investigate Comey’s former cases involving the mob, and even talked with a key government cooperator in a case early in Comey’s career, but that person did not recall ever discussing the term “86” with Comey. They found nothing.
