EAST
On the East coast, Sean Charles Dunn (the sandwich guy) was not found guilty (yet again).
Trump’s US Attorney for the District of Columbia and former Fox News “host” Jeanine Pirro failed again with her snowflake victim pretense of grave injuries to a heavily armed border officer from a tossed Subway sandwich.
The jury was not moved by claims of harm from the smell of mustard… especially given that the sandwich had been photographed still wrapped as it laid on the ground.
Yes, it appears very much that the agent just flat out lied.
They used our tax dollars to prosecute Dunn with a forcible assault, which required jurors to find that Dunn caused “reasonable apprehension of immediate bodily harm.”
A heavily armed border agent claimed to have felt at risk for immediate bodily harm from a wrapped sandwich. This is the party line Trump’s “gravy seals” are forced to present, where they claim to be both perpetual victims and also the most mighty of all military specimens to intimidate Americans who might object.
WEST
On the West coast, finding that Trump “did not have a lawful basis to federalize the National Guard” in Portland, on Friday U.S. District Court Judge Karin Immergut permanently blocked Trump from deploying the National Guard.
Central to this court finding is the real theme of Trump’s justification for his federal thugs being a rather constant and easily exposed lie.
Acknowledging that there had been some protest violence but noting that it had been dealt with by law enforcement, the Judge determined, “Since that brief span of a few days in June, the protests outside the Portland ICE facility have been predominately peaceful, with only isolated and sporadic instances of relatively low-level violence, largely between protesters and counter-protesters. This Court concludes that even giving great deference to the President’s determination, the President did not have a lawful basis to federalize the National Guard.”
It should surprise no one that a 34 times convicted felon has been found to have unleashed a violent, armed mob against the American people unlawfully. Naturally, the Trump DOJ argued that Trump should not be subject to judicial review. DOJ lawyer Eric Hamilton argued, “The president’s judgment is not subject to judicial review.”
To say this of any president is outlandish, but to say if of the man who has littered the White House with urgently-needed paper signs in his natural habitat of faux gold to signal the door that leads to the Oval Office is really something. The White House stands partially demolished right now, with plans for a grotesque Epstein Ballroom addition to replace the East Wing. This man does not have good judgement, let alone good taste. He never has.
Trump’s DOJ also tried to argue that because some people were arrested, they had justification to bring in the Guard, which makes no sense. People got arrested because local law enforcement did their job; they did not request or require any help doing their job.
But they lost. The Judge didn’t buy their lies. Their lies are easily disproved, and they are having trouble selling their lies to anyone outside of their epistemic bubble base.
MIDWEST
In Chicago, after Judge Sara Ellis of the U.S. District Court for the Northern Illinois issued a temporary restraining order requiring border patrol agents not to use excessive force on civilians and ordering that they must identify themselves and wear body cameras, Trump’s Border Patrol commander Greg Bovino threw tear gas shortly before a children’s Halloween parade.
He claimed he had been hit by a rock before he threw the tear gas.
Not true, plaintiffs say. They called that a fabrication, calling Bovino not credible, and saying that the video provided by the Trump government was spliced and curated.
Video footage was verified by ABC News showing the agents deploying tear gas:
Video footage that was verified by ABC News showed agents deploying tear gas and tackling and arresting several people, including U.S. citizens, outside homes decked out in Halloween decorations.
In one video confirmed by ABC News, resident Carlos Rodriguez is heard yelling at agents, “You’re scaring our children to death.”
“Plaintiffs allege Greg Bovino falsely claimed he was struck by a rock before authorizing tear gas during a Chicago protest, as the lawsuit against DHS takes a major turn in federal court,” Fox 32 Chicago reported.
Indeed, it was a major turn.
On Thursday, the Judge said that Bovino had LIED and then admitted that he was not hit until after he threw the tear gas:
“Mr. Bovino and the Department of Homeland Security claimed that he had been hit by a rock in the head before throwing the tear gas, but video evidence disproves this. And he ultimately admitted he was not hit until after he threw the tear gas,” Ellis said Thursday.
Not only did this incident reflect poorly on Bovino, but it also cast further doubt upon the entire DHS under Trump.
At the time of the incident, DHS defended Bovino’s actions saying that a Border Patrol transport van transporting undocumented immigrants was attacked by demonstrators.
What did Bovino do after being busted as a bald-faced liar? The next day, he claimed on social media that his agents had been “shot at”, and subjected to “vehicular assaults, physical assaults, impeding, violent mobs, vehicular blockades”, for a number of hours.
Do you smell mustard? Because I smell a lot of mustard. The mustard of propaganda that will only work on Trump’s easily duped supporters.
