The handcuffing of Sen. Alex Padilla is a moment that still shocks and appalls the nation. Even with all of the other news that has happened in the days since, the way that Sen. Padilla was treated by Homeland Security Secretary Kristi Noem and her security continues to generate headlines.
On his MSNBC program, The Last Word, Lawrence O’Donnell raised a different angle. What happened to Padilla was criminal.
Video:
Lawrence O’Donnell said:
What you see on that video of what they did is a crime. It is a crime against democracy, and it fits the elements of federal and state crime on false arrest. Just because the officers involved gave up trying to execute and complete that arrest does not mean that they did not violate the law. The federal code on unlawful detention says it is a violation of law if an officer apprehends arrests or confines any person without legal justification.
And the way to prove that legal justification is to charge the person with a crime who you've decided to handcuff and throw on the floor of a federal building. But they didn't do that because Senator Padilla committed no crime. Senator Padilla gave them no reason to legally do what they did.
The Trump administration is so criminally inclined that they are now, according to Lawrence O’Donnell, committing crimes against a member of the United States Senate.
Senator Padilla did nothing to deserve the treatment that he received from the Trump administration, but the hardworking people who are being rounded up by the Trump administration also committed no crime.
It is not a crime to be in the US illegally. It is a civil offense.
The Trump administration is weak and failing, which is why they are using every trick imaginable to attempt to project strength.
Even if he wanted to, which he has shown no indication that he does, there is no one for Alex Padilla to report the alleged crime against him to.
Donald Trump controls the entire federal law enforcement apparatus, but the people have seen the crime, and they will continue to use their voice and their power to reject this administration.
