The DOJ Is To Blame For Trump Skating On Criminal Charges
Joe Biden wanted to restore confidence and rebuild the culture at the Department of Justice after Trump’s term, so he nominated Merrick Garland, instead of a more aggressive prosecutorial option to be attorney general. The Biden administration believed that repairing the political culture would heal America, and they showed little interest in prosecuting Trump.
The Biden team’s lack of interest in a more aggressive nominee was reflected in their choice of Garland. Biden let the DOJ operate independently as it should, so he left the question of what to do with Donald Trump up to Garland. Not picking a prosecutor who would treat Trump and 1/6 like the DOJ’s top priority might go down in history as Biden’s biggest mistake.
As Senator-Elect Adam Schiff (D-CA) posted after Special Counsel Jack Smith filed to dismiss all charges against Trump, “The Justice Dept and the court system failed to uphold the principle that no one is above the law. DOJ by neglecting to promptly investigate the events of Jan 6, and the courts by willfully delaying progress of the case and providing immunity. The public deserved better.”
Donald Trump led a literal attack on the country, but Merrick Garland and the DOJ did nothing.
Garland and the DOJ only began to act after they were humiliated into action by the 1/6 Committee investigation.
By the time the DOJ was forced into action, it was already too late.
It was widely known that Trump was running for president again, and his plan was to stall and run out the clock if any charges were filed against him.
The classified documents case was botched by DOJ as they refused to try to get Trump appointee Judge Aileen Cannon off of the case, even though she spent the proceedings bordering on activism for the defendant.
Overall, the Biden DOJ placed too much importance on norms and civility even when dealing with the unprecedented situation of a criminal ex-president.
Merrick Garland is to blame for not launching an investigation of Trump sooner. There is no reason not to believe President Biden that he respected the independence of the DOJ, but Biden also chose the kind of attorney general that he wanted, so while the President did many wonderful things for the country, it is also possible that his attachment to the way government and Washington D.C. operated back in the day created a blind spot to how the Department of Justice should handle the Trump threat.
If the DOJ would have prosecuted Trump in 2021 or 2022, the former president’s delay tactics would not have worked.
Adam Schiff is correct. The American people did deserve better than this, and potentially, because the attorney general didn’t act sooner, Trump is set to return to the White House and potentially be more personally lawless than before.

Garland for slow walking; Biden for pushing this to his back burner. For all the good Joe Biden has done in the past four years, historically, allowing Trump to destroy it all will overshadow everything good.
All of the above, but primarily AG GARLAND and the corrupt US Supreme Court. Garland has been a bitter disappointment. And the corruption of the courts in general, in allowing someone like Cannon to hold her job.
